Abstract (German)

Die vorliegende Abhandlung beschäftigt sich mit außervertraglicher, insbesondere deliktischer, Haftung für verkörperte autonome Systeme und dem autonomen Automobil. Dabei erfolgt eine Betrachtung verkörperter autonomer Systeme aus rechtspolitischer und ökonomischer Sicht. Vor dem Hintergrund allgemeiner Grundsätze der deliktischen Haftung im deutschen Recht wird beleuchtet, inwiefern diese heute gültigen Regelungen auf die Zukunftsvision verkörperter autonomer Systeme und des autonomen Automobils anwendbar sind. Eine umfassende, rechtspolitische Einordnung und Bewertung möglicher Lösungsalternativen bildet den Kern der Abhandlung und mündet in einen eigenen Vorschlag für Regelungen de lege ferenda.

This book deals with non-contractual, in particular tortious, liability for embodied autonomous systems and the autonomous automobile. Embodied autonomous systems are analysed from a legal policy and economic perspective. Against the background of general principles of tortious liability in German law, the extent to which these currently valid regulations are applicable to the future vision of embodied autonomous systems and the autonomous automobile is examined. A comprehensive legal policy classification and evaluation of possible alternative solutions forms the core of the book and leads to an own proposal for regulations de lege ferenda.
