Abstract (German)

Die Dissertation vermittelt einen Überblick über die Entwicklung des Arzthaftungsrechts von der Antike bis in die heutige Zeit. Die Ausführungen sind in sechs Teile gegliedert. Die einzelnen Teile umfassen jeweils unterschiedliche Zeitabschnitte (Teil I: Einführung; Teil II: Antike bis 18. Jahrhundert; Teil III: 18. Jahrhundert bis 1950; Teil IV: Exkurs DDR; Teil V: 1950 bis heute; Teil VI: Zusammenfassung und Ausblick), bezüglich derer die Autorin anhand des soziologischen Hintergrunds, der rechtlichen bzw. normativen Grundlagen, des Anführens von Beispielsfällen und der Darstellung der Rechtsprechung sowie der Diskussionsgegenstände in der Literatur einen Einblick in die Fortentwicklung der rechtlichen Verantwortlichkeit der Ärzte gibt. Die Dissertation endet mit einer zusammenfassenden Stellungnahme und einem Ausblick.

Translation of the abstract (English)

The thesis provides an overview of the development of medical liability from Antiquity until the present day. The results of the research are presented in six parts. Each part focuses on a particular time period (Part I: Introduction; Part II: Antiquity to 18th Century; Part III: 18th Century to 1950; Part IV: Intermezzo, DDR; Part V: 1950 to present; Part VI: Summary and Outlook). Against a sociological background, and taking up current debates in legal scholarship, the author presents insights into the development of the legal liability of medics. Legal and normative foundations of such liability are explored, taking account of case law and literature, and illustrations are provided in the form of practical examples. The thesis concludes with a critical summary and an outlook into the future.
