Abstract (English)
The main thrust of this work has been to explore the norms of the 1983 new Code of Canon Law on new approaches to pastoral care for marriage preparation and certain mechanisms of marriage in the traditional African society as motivation for assistance in the formulation of appropriate guidelines and programmes for marriage preparation in the Ho diocese. The study realised that the old Code (1917) became outmoded because in the face of numerous problems confronting the marriage institution there is in fact more than just establishing freedom to marry. The immediacy of freedom to marry thus carried less potential safeguards to marriage and family life in the right approach to the pastoral care for marriage preparation. It insisted that the alarming rate of separation and divorces on the globe cannot totally be attributed to the heavy stress put on the freedom to marry; nevertheless, the study has shown how traditional methods which act as a check and balance on marriage are gradually being eroded; the directives of the 1983 new code which stresses the obligation of pastoral ministers to prepare Christ’s faithful for a better marriage and family life is acknowledged as more beneficial.
The initial theoretical concepts and surveys discussed in the beginning of the study have been to help determine the interactive effects of the genesis of marriage and pastoral care for marriage preparation in celebration of marriage. They pointed out how important it is for the legal conformity of marriage preparation in the Church embedded on the validity and liceity of marriage celebration must take into account a wider range of contributions including the anthropological, social, cultural and religious dimensions. The quest led to various anthropological theories about the mode of taking a wife among the pre-historic humankind. Some scholars believe that sexual behaviour among those pre-historic people was nothing more than promiscuity.
This theory proposed that the human race might have originally lived in a state of promiscuity where individual marriage did not exist. This suggests that all the men in a horde or tribe had indiscriminate access to all the women, since there were no social sanctions on sexual relations and for establishing a relatively permanent man to woman partnership. It therefore concluded that early cavemen might not be awake to the concept of biological paternity. Another theory identified “machoism” as a means of marrying or having a mate in those early days. This theory suggested that having a mate was only possible through force or capture of the females. Still another theory proposed that taking a wife was done through “wife purchase”. This practice, misunderstood as “wife purchase”, is still considered to be prevalent in Ghana because of the bride-wealth paid before religious or ordinance marriage in Ghana.
However, the theory which was most likely to be accepted as having a positive indication to moral order in the present generation, suggested the automated pairing of one man and one woman for a period more or less transitory. It presupposed that the origin of marriage might have originated in “pair marriages”, that is the pairing of one man and one woman in time. This might seen to be plausible since the numerous societies practiced premarital chastity, until recently very strictly adhered to in many societies in Ghana and the instinctual behaviour of some apes for a lifelong mate clearly demonstrated that man has always liked sexual exclusiveness and the social security of a woman in the cave. In other words, the original form of sexual union among the early races was the pair marriage – the union of one man and one woman for a period of time. We may call this type of marriage “transitional monogamy” or quasi-monogamous relationship. However, we remark that the great amount of variety in terms of number of wives in primitive societies suggests that the original form of marriage may not have necessarily been monogamous. Finally, we said that none of the theories can validly be proven to convince us about the actual mode of marriage among our progenitors because the institutions of the primitive man are not very clear to us, and we will never know; and most of the materials gathered from the surviving primitive tribes are tainted with exaggerations and modernity.
We also explored briefly how biblical usages and canonical codification contribute to the understanding of the marriage institution. The investigation found out that the institution of marriage was not categorically and sufficiently discussed in scripture, but there were many phrases, pronouncements, practices, symbolisms and utterances alluding to the teaching on marriage. However, we observed that the principal and most significant teaching concerning marriage, and for that matter, a hint on steps to be taken into account when preparing couples to appreciate the beauty of marriage and family life is set out in Pauline literature, especially in the so called “household codes (Haustafeln) tabulated in Col. 13:18-4:1 and Ephesians 5:21-33. These regulatory codes may be seen as a way of coping with the delay of the Parousia but we can assume that they prescribed a certain amount of knowledge concerning Christian and social behaviours in marriage and family. However, in the organisation of the regulatory rules there was a degree of inequality. This means that the household codes are saturated not only with the good and equitable relation, which ought to exist between husband and wife but also the unbalanced relation between man and woman.
The first impression one can gather from these relations is portrayed by a master-slave relationship. The woman is not allowed to be seen in public taking any leadership role. The role of leadership and responsibility is accorded the man or the husband, as the head of the wife while the latter must submit in obedience paralleling on Christ as the head of the Church. The man represents the family in public. The woman, on the hand, is responsible for bringing up and educating the children.
In spite of the conflict inherent in the household codes, reading the texts contextually reveals that it did not totally support male domination for that matter. From the very onset of the texts especially Colossians and Ephesians, Paul excellently dug out the details arising from the challenging teaching of concrete life. Hence, the texts in their contextual manner are not instructions to lay claim to the ambivalent nature of man and woman relationship, but that the “the entire system of social relationships is even held in check; submission in each of the relationships is to be adhered to in accordance with what is ‘fitting in the Lord’ (Col.3: 18-wives to husbands), ‘pleasing in the Lord’ (Col.3:20- children to parents), and showing respect and rendering service to ‘the lord’ (Col.3:22,23,24- servants to masters). Slave-owners are reminded that they are no different from slaves before God, who is impartial (Col.3:25) and to whom they must answer as their ‘master in heaven’ (Col. 4:1). He refers to various aspects of the husband- wife relationship such as mutual respect and fidelity, and the marital permanence among others. If the ideals presented in these texts are put into its practical terms, there will be no possibility of fighting over whom the head and leader of the household is i.e. craving for about authority rights.
We have also pointed out in the search for the origin of marriage in the history of canonical codification that the Church’s determination is ultimately to outline the basic principles underlying the standard judgement of the marriage institution. The fundamental issue for the Church is to share the meaning of marriage allowing for the capacity of those preparing for the sacrament to understand more or less what she means. We have seen that the definition of marriage went through changes in the course of legal history in the Church. The 1917 code of canon law described marriage as a sacrament, that is, as a contract between two baptised persons (cf. 1012) and the purpose of marriage is principally geared towards procreation and education, giving the second place to mutual love and conjugal life as the process of solving the problem of concupiscence in man. Moreover, the code put heavy stress on the freedom to marry. However, stress on the freedom to marry in the understanding of marriage gave way to the shift of emphasis in the drafting of the 1983 code on marriage.
Based on the GS document, the 1983 code defined marriage in the context of the biblical notion of covenant. The covenant terminology attempts to redefine and shift understanding of marriage from the outmoded perception of canonical law which saw marriage in the context of a contract. The content of the contract was primarily a right to acts fitting for procreation, while the vital aspect of marriage, “mutual love” was denigrated to the secondary end. Canons 1055 §1 of the 1983 Code of Canon Law and 776 §§1, 2 of the 1990 code of canons of the Eastern Churches attested to the shift we talked about.
From the above results of the research as appropriately addressing pastoral care for marriage preparation, the study has established that there were only three direct short pointers to marriage preparation in the documents of Vatican II; however, as Gavin reiterated, the image of marriage and family for which the Church intends couples to prepare is clearly outlined in a number of paragraphs of the pastoral constitution GS. The outline was given more clarification in the FC of 1981 on the role of the family in our turbulent world which was expanded in the determination and efforts of the PCF to give comprehensive details about pastoral care for marriage preparation. Following the thought of FC, pastoral care for marriage preparation was insisted upon as a life-time journey accompanied by remote, proximate, immediate, and post-marriage preparation stages. Each of the stages indicated an interrelationship highlighting collective and participatory responsibility. This means that the functioning of the stages is not only the responsibility of clergy but includes the whole community: parents, relatives, clans, the expertise of theologians and those skills in other fields of sciences, notably the law, medical, biological, anthropological, social and psychological, pooling their efforts and strength together with clear conscience to educate the youth, the most vulnerable, and the public in general about the sacredness and sanctity of marriage. In addition, it is the obligation of parents and the lineage to nurture children and young people in the traditional values and codes relevant to the acceptable behaviour in marriage and family life.
The theoretical and canonical survey of addressing the genesis of marriage as a guide for the approach to pastoral care for marriage preparation has been complemented by the details of socio-cultural notions of African customary marriage and family life in collaboration with the perspective of SECAM. The study justified that in Ghanaian societies marriage is found to be an important institution between opposite sexes and as a result must be accorded the highest respect and be protected. As such we acknowledged that the process of acquiring a wife in the traditional Africa society is by no means an issue of triviality because the survival of the family and the society depended on it. Hence the entire community, including living and dead, are involved in the marriage process. Thus it is sometimes difficult to make clear cut distinctions between the group and personal decisions in marriage.
We commented that this significant participation in the activities of the prospective couple is very fundamental to the social structure of the Ghanaian traditional family system because it gives the sense of dependability and availability of solutions to problems within the extended family relationships, as the couples know within their means they have to contribute to the large family, and the large family knows - without interfering in the private affairs- contribute to the well being of the couples especially in times of crisis. A typical example mentioned was the traditional way of settling disputes among couples or family members. We said that divorce is not anathema, in spite of the fact that the custom hates it since it is seen as a factor that can disintegrate and disorganise marital and family life, and sow seeds of contempt among families. Divorce is the prerogative of couples; however, it is preceded by family arbitration involving the heads of the two lineages or clans (Ametsitsiawo), the acknowledged representatives of the ancestors, who may persuade the couple for reconciliation.
In the discussed rites of customary marriage in Fodome traditional area, the study attempted to legalise the perceived idea that the marriage bond in African customary marriage comes about as a result of a dynamic process. Practically, there certain rituals persisted through various stages necessary in the preliminary negotiations which finally culminate in the ceremony of a bride’s ultimate journey of marriage in the abode of the bridegroom. We have also seen that the payment of bride wealth is very much essential to the process. Of course, in the Ghanaian traditional view Christian or ordinance marriage celebrated without performing the traditional rites is unacceptable, illegal and void. Even though the non-performance of customary rites has no effect on the canonical validity of marriage, the Ghanaian Church strongly insisted that the full customary rite be performed prior to the celebration of sacramental marriage in the church.
The study has also shown the perspective of SECAM on traditional marriage and sacramental marriage. SECAM strongly believed that certain cultural and social structures of marriage and family life in Africa provide a springboard for integration. This affirmation called for a formal integration of traditional values of marriage and family life in Africa into its pastoral and liturgical activities to bridge the gap between traditional and church celebrations of marriage.
In the same way SECAM recommended the formulation of sound policies and comprehensive programmes for marriage preparation. SECAM suggested that pastoral care for marriage should begin in childhood, intensify during puberty or adolescence, and must reach its culmination in the immediate preparation and celebration of marriage. In addition, there should be continuous formation for those recently married such as on matters bordering on how humankind’s relationship and married couples can grow, change, improve or deteriorate, therefore developing indicators which will accommodate living their daily life as couples and family in a generous and realistic manner. Accordingly, one would have thought that the documents and the solid proposals by SECAM would mean more to various dioceses and bishops’ conferences to promote and attach seriousness to it, but unfortunately, over the years the proposal remains archived in many dioceses. In other words, these handsome recommendations and proposals that raised interest have never materialised in most parishes in Ghana because there are no elaborate directives and programmes on marriage preparation. Moreover lack of success may be partly due to conflicts of interest which lay more emphasis on marriage counselling rather than on a qualitative approach to pastoral care for pre-marriage preparation.
The study also revealed that out of the 15 canons associated with marriage preparation in the 1917 Code only one canon (c.1033) truly speaks of marriage instruction. The particular instruction in canon 1033 must be directed towards the prospective spouse in a face-to-face manner with the parish priest who is to instruct them in such a way that they will receive the sacrament of matrimony in a pious and worthy manner. Moreover, the instruction is to ensure that the spouses may live out their future marriage life in a Christian fashion as opposed to the pagan marriages.

Es wird angenommen, dass eine der größten persönlichen Tragödien des modernen Menschen nicht auf die Entwicklungen unserer Zeit, sondern auf tiefgehende Problemstellungen, die die Institution Ehe mit sich bringt, zurückzuführen ist. In intensiven Gesprächen mit Betroffenen ist mir immer wieder gesagt worden, dass die Institution der Ehe und des Familienlebens in einer Krise steckt. Man kann nun fragen: Hat die Ehe tatsächlich ihr goldenes Zeitalter hinter sich? Sind Bedeutung und Zweck der Ehe tatsächlich bedroht? Wird aus Liebe geheiratet oder nur wegen sozialer Anerkennung, steuerlicher Vorteile, zur Erlangung einer Aufenthaltsgenehmigung? Fragen dieser Art könnte man endlos weiter formulieren. Ein Punkt ist jedoch von zentraler Bedeutung: Wie kann der eigentliches Sinn von Ehe wieder deutlich werden?
Für dieses ernste Anliegen müssen in der Seelsorge Wege gefunden werden, um die (christli-chen) Werte der Ehe wiederzuentdecken. Gesellschaft und Kirche müssen sich ihrer Verant-wortung bewusst werden, denn Ehe und Familie bilden ihre Grundlage. Tun sie das nicht und versäumen es, rechtzeitig zu handeln, werden auf lange Sicht nicht nur die Ehepaare, sondern auch Gesellschaft und Kirche die Konsequenzen tragen müssen.
Ein erster Schritt die Verantwortung zu übernehmen, kann die pastorale Ehevorbereitung sein. Daher obliegt es der Kirche und der Gesellschaft, die jungen Leute und Heiratswilligen durch geeignete Maßnahmen zu unterstützen und sie in den Normen und Werten der (christlichen) Ehe anzuleiten. Es ist wichtig, zukünftigen Paaren kulturelle und christliche Werte zu vermit-teln, um ihr Denken positiv zu formen. So können sie den wichtigen Werten des Ehelebens wie gegenseitige Liebe und Verbundenheit, Einheit und Unauflöslichkeit, Zeugung und Er-ziehung von Nachkommenschaft Ausdruck verleihen und danach streben, diese füreinander, für die Kirche und die Gesellschaft zu einem Segen werden zulassen.
Auch wenn wir nicht behaupten, wir wüssten genau, in wie weit die neuen Methoden der pas-toralen Fürsorge bei der Ehevorbereitung gemäß dem kirchlichen Gesetzbuch von 1983, Fehl-schläge verhindern und Paare während des ganzen Lebens unterstützen, sind wir jedoch si-cher, dass die sorgfältige Vorbereitung auf die Ehe die „Übel“ von Ehebruch, Scheidung und Ungültigkeit der Ehe, aber auch von Polygamie, welche Ehe und Familie dieser Tage bedro-hen, zumindest verringern kann. Deshalb legt der Codex des kanonischen Rechtes von 1983 wesentlich mehr Gewicht auf die inhaltliche Vorbereitung der Brautleute auf die Ehe als der Codex von 1917, bei dem vor allem die rein rechtlichen Fragen rund um die Eheschließung im Vordergrund standen.
Damit ist eine Neuausrichtung der Seelsorge in der Ehevorbereitung verbunden. Deshalb un-tersucht diese Doktorarbeit die Normen zur Ehevorbereitung im CIC/1983 und konfrontiert diese mit Bestimmungen der Eheschließung in der afrikanischen Gesellschaft, mit dem Ziel für die katholische Diözese Ho in Ghana angemessene Richtlinien und Programme zu formu-lieren.
Die Studie ist in vier Teile gegliedert. Die theoretischen Konzepte und Übersichten, die am Anfang der Studie diskutiert werden, sollen dabei helfen, die Wechselwirkungen zwischen der pastoralen Ehevorbereitung und dem Beginn einer Beziehung, die in einer Eheschließung mündet, zu bestimmen. Sie zeigen auf, wie wichtig es ist, dass in der kirchlichen Ehevorberei-tung die rechtlichen Fragen um die Gültigkeit und Erlaubtheit einer Eheschließung im größe-ren Zusammenhang der anthropologischen, sozialen, kulturellen und religiösen Dimension eingebettet sein müssen.
Kapitel I
The marriage Institution: Anthropological and Christian synopsis
1. The Anthropological theories of marriage
Hier werden verschiedene Theorien aus der Anthropologie vorgestellt, wo die Wurzeln der Institution Ehe liegen. Wie sind zu Beginn der Menschheit die ersten Lebensgemeinschaften von Mann und Frau entstanden: mit oder ohne einem formellen Akt, der als eine Heirat be-zeichnet werden könnte?
Diese Theorien stellen nicht nur den Versuch dar, die Urform der Verbindung zwischen Mann und Frau zu ergründen, sondern dienen auch als Mosaiksteine für ein umfassendes Verständ-nis der Ehe
• Die Theorie der „Promiskuität“ geht davon aus, dass die menschliche Rasse in einem Zustand der sexuellen Freizügigkeit lebte, indem es keine Heirat gab. Bachofen, der Hauptvertreter dieser Theorie, argumentiert in seinem Buch Mutterrecht, dass die Ge-schichte der Ehe mit einer allgemeinen Form der sexuellen Freizügigkeit anfing, dann als Polygamie und Gruppenheirat fortgeführt wurde und als Monogamie endete. Des-halb war seiner Meinung nach die Promiskuität die erste soziale Organisationsform der Urmenschen. Er legt dar, dass die ursprünglichen Menschen wie gesellige Tierarten in Horden lebten und völlige sexuelle Freizügigkeit vorherrschte, wodurch die Va-terschaft der Kinder oft unklar blieb. Die Abstammung wäre stets von den Frauen be-stimmt worden, da die Höhlenmenschen wohl nicht das Konzept der biologischen Va-terschaft kannten.
• Die Theorie des „Machismus“ geht davon aus, dass es nur durch Gewalt oder Gefan-gennahme von Frauen möglich war, einen Partner zu bekommen. Demzufolge entstand die Ehe durch Gefangennahme; das bedeutet Gewalt und Diebstahl durch Raub-überfälle von Männern auf die Frauen anderer Stämme.
• Die „Erwerbstheorie“ beinhaltet, dass das Nehmen einer Frau durch „Frauenhandel“ geschah. Die Theorie vermutet, dass, wenn die Männer einer Gruppe erkannten, dass die Männer einer anderen Gruppe lieber Frauen eintauschen wollten, als um sie zu kämpfen, einfach begannen, mit ihren Töchtern Handel zu treiben. Frauen wurden also schlicht als Tausch- und Verkaufsartikel betrachtet. Nach dieser Theorie ist die Heirat ein Handel und eine Angelegenheit des „Gebens und Nehmens“.
• Die „Ehepaar-Theorie“ besagt, dass ein Mann und eine Frau eine Bindung für einen mehr oder weniger langen Zeitraum eingehen. Es wird hierbei angenommen, dass der Ursprung der Ehe die Paar-Ehe ist, also wenn sich ein Mann und eine Frau ausschließ-lich aneinander binden. Das könnte positive Auswirkungen auf die Moral der jeweili-gen Generation haben. Wegen der sexuellen Exklusivität und dem starken Gefühl der Eifersucht, das im Menschen verwurzelt ist, wird hier die monogame Bindung für sehr wahrscheinlich gehalten. Wir stellen jedoch fest: Die höchst unterschiedliche Anzahl von Frauen in primitiven Gesellschaften bedeutet, dass die ursprüngliche Form der Ehe nicht unbedingt monogam gewesen sein muss.
2. Scriptural notions of Marriage
Die Betrachtung der biblische Bräuche und Vorschriften im Zusammenhang mit der „Ehe“ zeigt, dass die Ehe als Institution in der Heiligen Schrift nicht in allgemeingültiger oder aus-führlicher Form dargestellt wird. Es gibt keinen Zweifel, dass im Alten Testament Formulie-rungen wie „ein Mann nimmt sich eine Frau“, dieser Mann ist der Besitzer dieser Frau, und der Vater eines Mädchens hat seine Tochter einem Mann „gegeben“ (Dtn 11,16), ein Verhält-nis zwischen Mann und Frau widerspiegeln, das nicht nur auf einer biologischen, sondern auf einer viel tiefergehenden Personalitätsebene liegt. An zentraler Stelle in der Schöpfungsge-schichte, der Genesis, erschafft Gott Mann und Frau, und das Wort „ein Fleisch“ bringt uns die Großartigkeit von Liebe und Gleichberechtigung als Grundstein der Ehe zum Bewusst-sein. Allerdings legt die Wortwahl die Vermutung nahe, dass die Frau eine passive Rolle spielt und sie ihrem Mann als ihrem Herrn unterworfen ist.
Wir stellten ebenfalls fest, dass Polygamie im ehelichen Leben etlicher heiliger Patriarchen und Führer des jüdischen Volkes eine wichtige Rolle spielte. Es handelt sich jedoch hierbei um eine Sachlage von untergeordneter Bedeutung, weil im AT überwiegend von monogamen Verbindungen erzählt wird. In den Schriften der Weisheit, vor allem im Buch der Sprichwör-ter Kapitel 5, wird die monogame Ehe sowohl als normal wie als ideal angesehen. Demzufolge bewahren Verständnis und Besonnenheit den Menschen vor den Versuchungen des Ehe-bruchs, der in die Irre führt und Verbitterung, Blutvergießen und Tod hervorbringt. Er zerstört die Ehre, verschwendet Lebensjahre, plündert hartverdienten Besitz, verzehrt den Körper und bringt am Ende nur Bedauern. Nur eheliche Treue und die Liebe zur Ehefrau bringen Glück und Sicherheit. Diese Unterweisung wird folglich als Beweis betrachtet, dass Monogamie die Grundregel für eine Ehe ist. Daraus wird geschlossen, dass alle anderen Ehevarianten Zeichen des Niedergangs sind, die aus dem Sündenfall herrühren.
Wie bereits im AT, so gibt es auch im NT keine systematische Ehelehre, sondern nur Einzel-aussagen zur Ehe, die überwiegend in den Evangelien (Lk 16,18; Mk 10,1-12; Mt 5,31-32 und 19,3-12), den Schriften des heiligen Paulus, besonders wichtig 1 Kor 7, den Briefen an die Epheser (5,21-33) und Kolosser (3,18-4,1) und den Hirtenbriefen enthalten sind. Hier hat sich herausgestellt, dass mit großer Wahrscheinlichkeit die ersten Aussagen zur Ehe von Jesus selbst stammen als Reaktion auf entsprechende Fragen zu Ehebruch und Scheidung. Jesus lehrt mit Nachdruck die bedingungslose Treue in der Ehe, was eine Wiederverheiratung nach einer Scheidung ausschließt. Der heilige Paulus legt dies später so aus, dass keiner der beiden Ehepartner den Anderen fortschicken darf und, falls dies doch geschieht, nur zwei Möglich-keiten bleiben, entweder Versöhnung oder nicht wieder zu heiraten (1 Kor 7,10-11).
Diese Arbeit stellt gleichfalls fest, dass die Einstellung zur Ehe in den Schriften des heiligen Paulus vielschichtig ist. Die erste und wichtigste Lehre zur Ehe findet sich in den so genann-ten „Haustafeln“, die in Kol 3,18-4,1 und Eph 5,21-33 aufgeführt sind. Mit ihrer Hilfe kann auch heute noch Brautpaaren der tiefere Sinn von Ehe und Familie vermittelt werden. Diese Verhaltensregeln können so interpretiert werden, dass sie lediglich eine Überbrückung der Wartezeit bis zur Wiederkunft des Herrn darstellen; sie können aber auch so verstanden wer-den, dass sie so etwas wie überzeitliche Standards für das christliche Verhalten in Ehe und Familie zum Ausdruck bringen. Wenn dem so ist, dann ist allerdings die Tatsache problema-tisch, dass es in diesem Regelwerk ein Ungleichgewicht zwischen Ehemann und Ehefrau zu geben scheint, das einer Herr-Sklaven-Beziehung nahekommt. Der Frau ist es nicht erlaubt, in der Öffentlichkeit eine Führungsrolle zu übernehmen. Die Führung und Verantwortung ob-liegt dem Ehemann als Herrn über die Ehefrau, vergleichbar mit Christus als Haupt der Kir-che. Die Ehefrau hat sich in Gehorsam zu unterwerfen. Der Ehemann repräsentiert die Familie in der Öffentlichkeit, die Verantwortung der Frau ist es, die Kinder auf- und zu erziehen.
Trotz dieser Ambivalenz in den Haustafeln, enthüllt das sorgfältige Lesen im Kontext, dass die männliche Dominanz nicht grenzenlos ist. Von Anfang an, besonders in den Briefen an die Kolosser und Epheser, arbeitet Paulus in hervorragender Weise die Einzelheiten heraus, die sich als Herausforderungen im tatsächlichen Leben ergeben. Daher sind die Texte ihrem Sinn nach keine Anweisungen, in denen die zwiespältige Natur der Beziehung zwischen Mann und Frau betont werden soll, sondern Anweisungen, um das gesamte Netzwerk gesellschaftlicher Beziehungen im Gleichgewicht zu halten. Unterordnung in diesem Netzwerk wird dadurch begrenzt, was gottgefällig ist (Kol 3,18: Ehefrau – Ehemann), (Kol 3,20: Kinder – Eltern) und indem man dem Herrn Ehrfurcht zeigt und ihm dient (Kol 3,22-24: Diener - Herr). Eigentümer von Sklaven werden daran erinnert, dass sie vor Gott nicht besser gestellt sind als die Sklaven. Gott ist unparteiisch (Kol 3,25), vor Ihm müssen sie sich als Ihrem „Meister im Himmel“ (Kol 4,1) verantworten.
Paulus bezieht sich auf die verschiedenen Aspekte des Verhältnisses zwischen Ehemann und Ehefrau, unter anderem auf gegenseitigen Respekt und Treue und die Beständigkeit der Ehe. Wenn die Ideale, die in diesen Texten vorgestellt werden, im täglichen Leben umgesetzt wer-den, bleibt kein Raum für den Streit, wer nun der Haushaltsvorstand ist und die Autorität besitzt.
3. Legalisation of the institution of marriage in the Church
Erste rechtliche Festlegungen zur Ehe stammen von den Römern, die festzulegen versuchten, was eine Heirat bedeutet. Die Römer erstellten die ersten zwei Definitionen der Ehe. Modestinus stellt fest: „Ehe ist eine Verbindung von Mann und Frau und eine Gemeinschaft für das ganze Leben, eine Teilhabe an göttlichem und menschlichem Recht.“ Ulpian definiert: „Heirat oder Ehe ist eine Vereinigung von Männlich und Weiblich, die eine unteilbare ge-meinsame Lebensführung einschließt.“ Die beiden Definitionen mögen unterschiedliche In-terpretationen erlauben, beide jedoch verstehen die Ehe als eine streng heterosexuelle Verbin-dung zwischen Mann und Frau, Ehemann und Ehefrau, mit der Absicht, das ganze Leben zusammen zu bleiben, mit festgelegten Rechten und Verpflichtungen.
Die Definition der Ehe im CIC/1917 wurde erheblich durch das römische Recht in Verbin-dung mit der geschlechtlichen Vereinigungstheorie des Gratian, der Einwilligungstheorie des Petrus Lombardus und der Lehre von den Ehegütern des Augustinus beeinflusst. Der kirchli-che Gesetzestext über die Ehe beginnt im CIC/1917 mit der Beschreibung der Ehe als Ehevetrag zwischen zwei Getauften, der Sakrament ist (c.1012) und stellt ihren Zweck wie folgt fest: „Zu allererst dient die Ehe der Zeugung und Erziehung von Kindern, und erst in zweiter Linie der Abhilfe der Fleischeslust“ (c.1013 §1). Die personale Dimension der Ehe als eine Gemeinschaft von Mann und Frau wird hier nicht thematisiert. Es geht vielmehr nur um die Zeugung von Kindern als eigentlichem Zweck der Ehe und alle für die Fortpflanzung er-forderlichen Handlungen.
4. The preliminary canon on marriage in the 1983 code
Auf der Ehelehre des II. Vatikanischen Konzil in „Gaudium et spes“ aufbauend, wird die Ehe im CIC/1983 zuerst als Bund beschrieben (c.1055 §1). Damit wird die einseitige Bestimmung der Ehe als Vertrag, wie es im CIC/1917 der Fall war, überwunden. Dementsprechend ist nicht mehr vom ersten und zweiten Zweck der Ehe die Rede, sondern von zwei (gleichrangi-gen) Zielen: das Wohl der Ehegatten, und die Zeugung und Erziehung von Kindern. Nach diesem Eheverständnis ist Ehe eine umfassende Liebes- und Lebensgemeinschaft, die aus der unwiderruflichen persönlichen Zusage der Ehepartner entsteht. Sie ist aber auch Ehevertrag, der unter getauften zugleich Sakrament ist (c.1055 §2). Trotz des Bundesverständnisses hat der kirchliche Gesetzgeber im CIC/1983 das Vertragsverständnis nicht aufgegeben, wohl aber relativiert.
Kapitel II
Customary marriage in Ghana
Kapitel II befasst sich mit der Situation und den Gepflogenheiten von Ehe und Familie in Afrika; wichtige Stichworte sind hier der Brautpreis, die in den Vorstellungen von Fruchtbarkeit begründete Polygamie, die Würde und Rechte der Ehepartner im Zusammenhang mit der in Afrika bzw. Ghana landesüblichen Ehe.
1. Features of customary marriage
Im Allgemeinen gibt es drei Arten von Ehen, die in Ghana familienrechtlich akzeptiert werden: erstens Ehen nach dem überkommenen Gewohnheitsrecht, die der Staat Ghana als gültig anerkennt, sofern die traditionellen Gesetze und Vorschriften, die von Gesellschaft zu Gesellschaft bzw. Ethnie zu Ethnie unterschiedlich sind, eingehalten werden; zweitens moslemische Ehe und drittens standesamtlich oder kirchlich geschlossene Ehen. Allerdings ist anzumerken, dass standesamtlich und kirchlich geschlossene Ehen streng monogam sind und dass es Personen, die so geheiratet haben, gesetzlich verboten ist, während der Fortdauer dieser Ehe eine gültige Ehe nach dem Gewohnheitsrecht zu schließen.
In Ghana ist die Ehe eine wichtige Angelegenheit zwischen den beiden Geschlechtern des Brautpaares, der deshalb große Hochachtung entgegengebracht wird und die absolut geschützt werden muss. Dabei spielt auch die Brautwerbung eine zentrale Rolle, da von ihr das Überleben der Familie und des Stammes abhängen.
