Abstract (German)

Die Arbeit hat die Analyse der Nachbesetzungsregelungen des § 103 Abs. 3a – 6 SGB V zum Gegenstand, also inwiefern ein Vertragsarztsitz bzw. einzelne Stellen angestellter Ärzte in einem zulassungsbeschränkten Bereich nach zu besetzen sind. Diese Fragestellung wird dabei anhand einer Abwägung der individuellen Freiheitsrechte, insbesondere des Eigentumsrechts nach Art. 14 Abs. 1 GG, mit den öffentlichen Bedarfsinteressen unter Berücksichtigung der einfachrechtlichen Regelungsstrukturen und des Statusrechts der Leistungserbringer beantwortet. Im Ergebnis zeigt sich, dass dringender Überarbeitungsbedarf besteht, da die bisherigen Regelungen grundlegende Garantien des Eigentumsschutzes der Leistungserbringer nicht berücksichtigen.

This dissertation analyzes the provisions of § 103 para. 3a - 6 SGB V, thus the extent to which a licensed medical seat or individual positions of salaried doctors in a restricted admission area within in the public health insurance system are to be reoccupied. Translation of the abstract (English)

This dissertation analyzes the provisions of § 103 para. 3a - 6 SGB V, thus the extent to which a licensed medical seat or individual positions of salaried doctors in a restricted admission area within in the public health insurance system are to be reoccupied. This question is answered by weighing the individual rights of freedom, in particular the right to property according to Art. 14 Para. 1 GG, with the public interests of need, taking into account the regulatory structures under simple law and the status rights of the health care providers. The result shows that there is an urgent need for revision, since the previous regulations do not take into account fundamental guarantees of property protection of the health care providers.
